🚨 Aviara Golf Course Home Sale Drama: Family Feud, Legal Battles, and Termite Swarms! 🚨
Selling this beautiful Aviara Golf Course home was a real challenge from start to finish! What should have been a smooth sale turned into a real estate nightmare when six siblings—all beneficiaries—started fighting over the property.
Two brothers listed the home without the approval of the others, leading to a court dispute. After the legal battle, the court appointed a fiduciary, removed the original realtor, and brought me in to take over. Despite the breathtaking location overlooking the 17th hole, the real challenge was managing four attorneys, constant family conflicts, and the court-imposed 35-day notice of proposed action.
Unexpected Drama:
During an open house, a termite swarm hatched right in one of the bedrooms! My lender and I borrowed a vacuum from the buyer, closed the door, and kept vacuuming up termites as they flew around the room and landed on the carpet—all while keeping the interested buyer from seeing the chaos.
Escrow Chaos:
After 38 days, we finally got all sibling approvals. Then, a new offer came in $200K higher, forcing the original buyer to match it—only to back out on the last day of escrow! I was able to get a price reduction to the original offer and told the buyer’s agent. The buyer agreed, and we closed escrow in one day.
The Real Victory:
In the end, the real success was getting the major conflict (the home) sold so the family could begin to reduce the fighting. It’s always a great feeling to know I did an excellent job despite all the family drama and litigation that kept them engaged over their mother’s home.
Sometimes, the biggest win is simply being able to move forward after a challenging transaction!
